Terms of Use & End-User License Agreement

1. Agreement

By downloading, installing, or using Video Tagger ("the Software"), you agree to these Terms. The Software is licensed, not sold, by Duijiaozhen ("we", "us").

2. License grant

Subject to these Terms and payment of any applicable fees, we grant you a non-exclusive, non-transferable license to install and use the Software on devices you own or control, for personal, non-commercial use. A Pro license is valid for one user across a reasonable number of personal devices.

3. Restrictions

You may not redistribute, resell, or sublicense the Software.
You may not reverse engineer, decompile, or disassemble the Software, except to the extent permitted by applicable law.
You may not remove or alter copyright, trademark, or other proprietary notices.
You may not use the Software to violate the rights of any third party or any applicable law.

4. Your content and your library

The Software operates on files on your local machine. You retain all rights to your files. You are solely responsible for ensuring that your use of the Software with your files complies with applicable law and any third-party rights.

We do not verify the legality of files in your library and do not assume responsibility for their content.

5. Third-party services

The Software can be configured to query third-party metadata providers (such as TMDB) using credentials you supply. Your use of those services is governed by the providers' own terms. We are not responsible for third-party services.

6. Updates

We may release updates to the Software. Updates may add, change, or remove features. We will use reasonable efforts to maintain backwards compatibility for files written by previous versions.

7. Disclaimer of warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. While the Software is designed to preview every change before writing to disk and to support undo, you are responsible for maintaining your own backups.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Termination

This license terminates automatically if you breach these Terms. Upon termination, you must cease using the Software and remove all copies from devices you control.

10. Governing law

These Terms are governed by the laws of the People's Republic of China (Shanghai), without regard to conflict-of-law principles.
